Terms of Service
These Terms of Service ("Terms") are the agreement between you and the operators of klans.net ("KLANS", "the Platform", "we", "us"). They apply when you create an account or otherwise use the Platform. If you do not accept them, please do not use KLANS.
KLANS is free to use. There is no subscription, and we do not currently sell anything on the Platform.
Our Privacy Policy explains what we do with your personal data and forms part of your relationship with us, though it is not part of this contract in the sense of imposing obligations on you.
1. Who we are and how to reach us
KLANS is operated jointly by two private individuals:
Riad Hodžić, Fasanenstraße 116, 82008 Unterhaching, Germany
Jordy de Koning, Dwergmeeuw 6, 1704 XK Heerhugowaard, Netherlands
We are jointly responsible for the Platform, and you may address any matter under these Terms to either of us.
Single point of contact. For all communications from members, authorities, and rights holders — including notices about illegal content, appeals, and legal service — use contact@klans.net. Business inquiries: business@klans.net. We communicate in English, German and Dutch.
2. Definitions
- Member / you — a person with a KLANS account.
- User Content — anything you post, upload or submit: posts, comments, images, your bio and profile details, clan and event descriptions, LFP posts, direct messages, and answers to event signup questions.
- Clan — a member-created group with its own page, wall, membership and roles.
- Event — a member-created gathering listing (tournament, raid night, session) with RSVPs, participant roles and optional signup questions.
- LFP — a "Looking For Play" post seeking teammates or opponents.
- Soft suspension — a temporary restriction of certain account functions (such as posting, messaging or uploading) while your account otherwise remains intact. See Section 12.
3. Eligibility
You must be at least 16 years old to use KLANS. By registering you confirm that you meet this requirement and that the information you give us is accurate.
If we have reasonable grounds to believe an account holder is under 16, we will restrict the account and ask for clarification, and we will close it if the concern is not resolved.
You may not use KLANS if a previous account of yours was permanently banned, unless we have agreed otherwise in writing.
4. Your account
- Keep your login credentials confidential. You are responsible for activity that occurs under your account, unless it was not attributable to you — for example where your account was compromised through no fault of yours and you told us promptly.
- Tell us at contact@klans.net as soon as you suspect unauthorised access.
- Give us a working email address and keep it current. We use it for password resets and important account notices, and we may be unable to help you recover an account without it.
- If you register through Google, Discord, Twitch or Steam, your use of that provider is governed by its own terms. We are not responsible if a provider changes or withdraws its sign-in service; where that happens we will try to give you a way to keep your account.
- One person, one account. Additional accounts are not permitted where they are used to evade a suspension or ban, manipulate votes, likes, RSVPs or rankings, or to spam or harass. Do not sell, rent, trade or transfer your KLANS account.
- You can delete your account at any time — from your profile dashboard where that option is available to you, or by writing to contact@klans.net, which we act on either way. What happens to your data afterwards is set out in our Privacy Policy.
5. The service we provide
- KLANS is a social platform for gaming: profiles, walls, posts, clans, events, game pages, Looking For Play, and direct messages.
- KLANS is provided free of charge. We may introduce paid features in future; if we do, they will be optional and clearly identified, and the free features you already use will not be put behind a paywall retroactively without notice under Section 18.
- We may add, change, or discontinue features. Where a change materially reduces functionality you rely on, we will give reasonable notice, and you may stop using KLANS and delete your account.
- Features marked as beta or experimental may be incomplete or unstable and may be withdrawn at any time.
- Automated access. Do not use bots, scrapers, crawlers or automated tools against the Platform beyond what a standard browser does, except for search engine crawlers acting within our robots.txt. Do not collect or compile member data — including profiles, posts or images — for external databases, mailing lists, resale, or for training machine-learning models, without our prior written permission.
6. Community rules
KLANS is built for gaming and for gamers. The rules below define what is allowed. Detailed, plain-language explanations and examples live in our Community Guidelines, which form part of these Terms.
6.1 Keep it gaming
Posts, images and clan or event content should relate to games, the community around them, or your gaming life. Holiday albums, unrelated lifestyle content and general off-topic posting belong elsewhere. We may remove off-topic content. This is the mildest category of rule: off-topic posts are removed, normally with a note, and repeat offending can lead to restrictions.
6.2 No political or religious campaigning
KLANS is not a venue for political or religious debate, campaigning, recruitment, or the promotion of political or religious organisations, movements or causes. This rule targets the conflict such debate reliably brings, not your beliefs.
To be clear about the edges: discussing the actual content of a game — including games with political, historical or religious themes — is allowed. Wearing, naming or depicting a real-world political symbol in your profile, clan identity or content is not.
6.3 No leaks, no piracy
Do not post, share, embed or link to unreleased or unauthorised material: leaked builds or footage, datamined content not intended for release, pirated or cracked game files, key-generators, or sites hosting them. This applies whether or not you created or uploaded the material yourself.
Beyond our rules, distributing or facilitating access to such material infringes copyright and can have serious legal consequences for you personally. We remove this content on sight, act against the accounts involved, and cooperate with rights holders and authorities where legally required.
6.4 No doxxing, harassment or pile-ons
Do not publish another person's private information without their consent, and do not harass, bully, threaten, stalk, or mob anyone — individually or as a coordinated group, on walls, in comments, in DMs, in clan chats or anywhere else on the Platform. Rivalry between players and clans is part of gaming; targeting a real person is not.
6.5 No sexual content or nudity
No nudity, sexually explicit or sexually suggestive content, and no "stream clip" framing that exists to get around this rule. KLANS is for clips, stats and strategy. Content sexualising a minor in any form is not merely banned — it is reported to the competent authorities without exception.
6.6 Spoilers need tags
Major plot points, endings, boss fights and twist reveals need a spoiler tag. Untagged spoilers may be removed or tagged by us.
6.7 Fair play and platform integrity
Do not:
- promote, sell or link to cheats, hacks, aimbots, exploits or boosting services;
- trade, sell or buy accounts, whether KLANS accounts or game accounts;
- impersonate KLANS staff, moderators, publishers, or any other person;
- brigade, review-bomb, or manipulate votes, likes, RSVPs, rankings or reports;
- spam: flooding pages with links, referral codes, advertising or repetitive content;
- exploit bugs or vulnerabilities instead of reporting them responsibly to contact@klans.net;
- circumvent moderation, suspensions, bans or rate limits, including through additional accounts.
We treat responsible disclosure of a security vulnerability as helpful behaviour, not a violation, provided you report it to us promptly, do not access other members' data beyond what is necessary to demonstrate the issue, and do not make it public before we have had a reasonable chance to fix it.
6.8 Illegal and harmful content
Do not post, upload, share or link to content that is illegal, defamatory, hateful, discriminatory, or that incites or glorifies violence or self-harm; malware, phishing or scam content; or anything that infringes the intellectual property or personality rights of others.
6.9 Your responsibility for your content
You are responsible for your User Content and confirm that you have the rights necessary to post it, including rights to images you upload and to content you embed.
7. Your content and the licence you give us
- You keep ownership of your User Content. Nothing here transfers it to us.
- Licence to operate the Platform. You grant us a non-exclusive, worldwide, royalty-free licence to store, host, reproduce, adapt (only technically — for example resizing images, generating thumbnails, transcoding), display and distribute your User Content, for the purpose of operating the Platform and making your content available to the people you posted it for. This licence is sublicensable only to the service providers we use to run KLANS (such as our hosting provider), and only to that extent.
- Promotion. We may show your public User Content in material promoting KLANS itself — for example a screenshot of a public clan page. If you ask us not to, we will stop using your content that way going forward.
- The licence ends when the content does. When you delete User Content or your account, the licence ends, except that (a) copies may remain in encrypted backups until they expire on our normal backup cycle, (b) content you sent to others (such as direct messages) remains with the recipient, and (c) we may retain material where the law requires it or where it is needed as evidence in an ongoing complaint or dispute.
- We may remove content that breaks these Terms or the law, subject to Section 12.
- Between members: posting public content does not license other members to reuse it beyond the sharing features KLANS provides.
8. Third-party embeds and links
KLANS displays embeds and links from third-party platforms, including YouTube, Dailymotion and Twitch, plus links added by members.
- Third-party content is governed by that party's own terms and privacy policy.
- We do not control, endorse or take responsibility for third-party content, embeds, or the destination of external links, even where they appear inside a KLANS page.
- If an embed or link breaches these Terms — illegal content, scams, malware — report it under Section 11 and we will review it.
How embeds load, and what the third party receives when they do, is described in our Privacy Policy.
9. Clans, events and Looking For Play
- Clan leaders and administrators are responsible for their clan's page, wall and members' conduct on it, and must enforce these Terms within their clan. Persistent failure to do so can lead to action against the clan and its leadership.
- Event organisers are responsible for the accuracy of their event listings, for the questions they ask participants at signup, and for the conduct of the event on the Platform. Do not ask participants for sensitive personal information (health, religion, political views, sexual orientation, identity documents) in signup questions or LFP posts.
- Meetings, tournaments and any activity taking place outside KLANS are organised by members at their own risk. We are not an organiser, participant or intermediary, we do not verify organisers, and we are not liable for what happens at member-run events.
- We are not a party to disputes between members, clans, or event organisers and participants, and we do not arbitrate them. We may intervene where these Terms or the law are breached.
- We may reclaim or reassign inactive clan names and abandoned clan pages, and remove events that have clearly been abandoned.
10. Game and publisher content
Game pages display titles, artwork and official news relating to third-party games for informational and community purposes. KLANS is an independent project and is not affiliated with, endorsed by, or sponsored by any game publisher, developer or platform referenced on the Platform. All trademarks, game titles and publisher content remain the property of their respective owners. Publisher news is reproduced from official feeds; we do not guarantee its accuracy or timeliness.
11. Reporting illegal content or rule violations
Anyone — member or not — can notify us of content on KLANS they consider illegal or in breach of these Terms, using the report function on the content itself or by writing to contact@klans.net.
To let us act quickly, please include:
- a link to the specific content;
- an explanation of why you consider it illegal or in breach, and which rule applies;
- your name and email address (not required for reports concerning sexual abuse material);
- a statement that you believe your report is accurate and complete in good faith.
We confirm receipt of reports sent by email without undue delay, decide on them in a timely, diligent, non-arbitrary and objective manner, and inform the reporter of our decision. Where we become aware of information suggesting a criminal offence involving a threat to someone's life or safety, we inform the competent authorities.
Deliberately submitting manifestly unfounded reports, or repeatedly abusing the report function, can itself lead to restrictions on your account, after a warning.
12. How we moderate, and how you can appeal
We want this section to be honest about how moderation actually works here, including where machines are involved.
12.1 What we do
We may remove or restrict visibility of content, apply a spoiler tag, suspend an account temporarily ("soft suspension"), or terminate an account permanently, where these Terms, the Community Guidelines or the law are breached.
We apply these rules diligently, objectively and proportionately, with regard to the interests and fundamental rights of everyone involved — including your freedom of expression.
12.2 Automated moderation
We use automated systems to detect spam, abuse and prohibited content, and to apply rate limits. These systems can place an account in soft suspension before a human has reviewed the case.
Because automated systems make mistakes:
- every soft suspension is entered in our internal report system and reviewed by a human at least once every day, and lifted if it was wrong;
- you can request review immediately at contact@klans.net, and you are entitled to human review, to state your case, and to contest the decision;
- permanent bans and account deletions are never automatic — a human decides them.
12.3 You will be told why
Where we remove your content or restrict your account, we tell you — normally at the time, and at the latest when you ask — what was affected, what rule or legal ground it was based on, whether automated means were used in detecting or deciding it, and how to appeal.
12.4 Appeals
To appeal any moderation decision, write to contact@klans.net within 6 months of being informed of it, naming the content or account and explaining why you think the decision was wrong. Appeals are decided by a person who was not responsible for the original automated detection, and we aim to answer within 14 days. If we agree we got it wrong, we reverse the decision and restore the content or account where technically possible.
Appealing to us does not take away your right to go to court.
12.5 Repeat and serious violations
We may suspend, for a reasonable period and after a warning, members who frequently and manifestly post content that breaks these rules. Categories in Sections 6.3, 6.4, 6.5 and 6.8 are serious enough that a single violation can lead directly to a permanent ban without a prior warning, and content sexualising minors always does.
13. Copyright complaints
If you are a rights holder — or acting for one — and believe content on KLANS infringes your rights, write to contact@klans.net with:
- identification of the work and of the infringing content (direct link);
- your contact details and your basis for acting;
- a statement, made in good faith, that the use is not authorised by you, your agent or the law.
We remove or disable confirmed infringing material promptly and notify the member who posted it, who may appeal under Section 12.4 — for example if they hold a licence. Accounts that repeatedly infringe are terminated. Knowingly false takedown claims may make you liable for the resulting damage.
14. Our intellectual property and your feedback
- The KLANS name and logo, the Platform's design, and its underlying software are owned by the operators named in Section 1 and may not be copied, reproduced, modified, or used commercially without our prior written permission. Nothing in these Terms grants you a licence to our trademarks.
- You may of course link to KLANS pages and use the sharing features we provide.
- If you send us suggestions, feature ideas or feedback, we may use them without restriction and without owing you compensation. We will not treat them as confidential, so please don't send us anything you consider secret.
15. Suspension and termination
- By you: you may delete your account at any time, without giving a reason — from your profile dashboard where that option is available to you, or by writing to contact@klans.net.
- By us: we may suspend or terminate your account where you breach these Terms, where your conduct causes serious harm to the Platform or other members, or where we are legally required to. Except in cases of serious or repeated violations, illegal content, or a legal obligation, we will warn you first and give you a chance to fix the problem.
- Notice: we will tell you the reason for a termination and how to appeal, unless the law prevents us from doing so.
- Discontinuation: if we ever shut KLANS down, we will give members at least 30 days' notice where circumstances allow, and a way to export their content before the Platform closes.
- Survival: Sections 7.4, 10, 14, 17, 19 and 20 survive termination.
16. Availability and warranties
- We provide KLANS with reasonable care and skill, but we do not promise that it will be uninterrupted, error-free, or free of data loss. Maintenance, technical faults and third-party outages happen.
- Keep your own copies of content that matters to you. Our backups exist to recover the Platform, not to restore individual members' deleted content.
- We do not verify member identities and do not vouch for the accuracy of User Content, third-party embeds, or publisher news feeds.
- Nothing in this Section limits any statutory rights you have as a consumer, or our liability under Section 17.
17. Liability
- We are fully liable for damage caused intentionally or by gross negligence, for injury to life, body or health, for damage covered by mandatory statutory liability (including, where applicable, the German Product Liability Act), and where we have given a guarantee.
- In cases of slight negligence, we are liable only where we breach an obligation that is essential to the proper performance of this agreement and on which you may reasonably rely (a "cardinal obligation"). In that case our liability is limited to the damage typical for this kind of agreement and foreseeable at the time of contracting.
- Any other liability is excluded. In particular, given that KLANS is provided free of charge, we are not liable for indirect or consequential loss, lost profits, lost data beyond the cost of restoring it from a backup you should reasonably have kept, or lost goodwill.
- We are not liable for the conduct of other members, for User Content, for third-party embeds or linked sites, or for anything that happens at member-organised events outside the Platform.
- The limitations above also apply in favour of both operators personally.
- Nothing here excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer protection rules in your country of residence.
18. Changes to these Terms
- We may amend these Terms where there is a valid reason — new or changed features, security or abuse concerns, or changes in the law.
- We will notify you of material changes by email or an in-app notice at least 30 days before they take effect, highlighting what has changed.
- If you do not accept the changes, you may delete your account before they take effect. Continuing to use KLANS after that date means you accept the new Terms; we will say so clearly in the notice.
- Minor changes that do not affect your rights or obligations (typo fixes, clarifications, reorganisation) take effect when published.
- Previous versions are available on request at contact@klans.net.
19. Governing law, courts and consumer rights
- These Terms are governed by German law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.
- If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence. You may also bring proceedings against us in the courts of your country of residence, and we may only sue you there.
- If you are not a consumer, the courts at the place of business of the operator you are in dispute with have jurisdiction, to the extent legally permissible.
- Consumer arbitration (§ 36 VSBG, Germany): we are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
- The EU Online Dispute Resolution platform no longer exists — it was discontinued on 20 July 2025 when Regulation (EU) 2024/3228 repealed its legal basis — so this section deliberately contains no link to it.
- For disputes about our removal of content or restriction of an account, see also the appeal route in Section 12.4.
20. Final provisions
- Severability: if a provision of these Terms is or becomes invalid, the remainder stays in force, and the invalid provision is replaced by the applicable statutory rule.
- No waiver: if we do not enforce a provision immediately, we do not lose the right to enforce it later.
- Assignment: you may not transfer your rights under these Terms. We may transfer ours to a successor operating the Platform, provided your rights are not reduced; you will be notified in advance and may delete your account if you object.
- Entire agreement: these Terms, the Community Guidelines and the Privacy Policy are the whole agreement between us about the Platform.
- Language: the English version is authoritative. Translations are provided for convenience.
- Contact: contact@klans.net for anything under these Terms; business@klans.net for partnerships.
